These Terms of Service ("Terms") govern your use of this website and the services offered through it. The website and services are operated by Trango Freight Forwarding Inc. ("Trango", "we", "us"), a licensed Ocean Transportation Intermediary (OTI) regulated by the U.S. Federal Maritime Commission under FMC OTI License No. 034819NF, operating the EVERSAIL Global brand. By using this website or requesting a quote, you agree to these Terms.
We provide U.S. destination-side international freight forwarding and related logistics services, which may include ocean freight forwarding and NVOCC services, U.S. customs clearance, Importer of Record (IOR) and customs bond arrangements, drayage, warehousing and delivery, delivered-duty-paid (DDP) arrangements, and duty/fee advancement. The specific scope of any engagement is defined by the written quotation and booking confirmation agreed between you and us, which take precedence over any general description on this website.
Any rates, ranges, or figures shown on this website — including the landed-cost estimator — are for reference only and do not constitute a binding offer or firm quotation. Ocean freight rates fluctuate with the market, and duties are assessed according to the actual applicable HTS classification determined by U.S. Customs and Border Protection. Firm pricing is provided by us in writing after manual review. Commodities subject to antidumping/countervailing duties (AD/CVD), FDA, Section 232, lithium battery, or other regulatory requirements require separate manual verification. A quotation is valid only for the period and conditions stated on it.
You are responsible for providing true, complete, and accurate information about the cargo, its value, its classification, and the consignee. You represent that the goods are not prohibited or restricted for import and that all information you provide is correct. Charges, penalties, seizures, examinations, demurrage, detention, or other liabilities arising from inaccurate declarations, non-compliant goods, or events beyond our reasonable control are the responsibility of the party at fault.
Duties, taxes, and regulatory fees advanced on your behalf are settled against supporting documentation. Payment terms, credit arrangements, and settlement methods are as agreed in writing between the parties. Unforeseeable charges (such as port storage, examination, or demurrage) are communicated as soon as practicable and settled against documentation.
Our services are performed in accordance with the terms and conditions of our bill of lading, our published NVOCC tariff, and applicable law, which govern the limits of our liability. We are not liable for delays, losses, or damages caused by carriers, customs authorities, government action, force majeure, or circumstances beyond our reasonable control. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws principles.
